Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, products, subscriptions, and services provided by Pro Tech AI (Pty) Ltd ("Pro Tech AI", "we", "us", or "our"). By subscribing to, purchasing, or using our services, you agree to be bound by these Terms.

1. About us

Pro Tech AI (Pty) Ltd is a company registered in South Africa. We build and operate business software and AI products, offered on a subscription or project basis.

2. Eligibility and account

To purchase a subscription you must be at least 18 years old and have the legal capacity to enter into a binding agreement. You are responsible for providing accurate information and for maintaining the confidentiality and security of any account credentials issued to you. You are responsible for all activity that occurs under your account.

3. Subscriptions and billing

  • Subscriptions are offered on a recurring basis (for example monthly or annually) as selected at the time of purchase.
  • Subscription fees are billed in advance for each billing cycle and are charged to your selected payment method.
  • Unless otherwise stated, subscriptions renew automatically at the end of each billing cycle until cancelled in accordance with our Cancellation Policy.
  • All fees are quoted in South African Rand (ZAR) and, where applicable, are inclusive of VAT unless stated otherwise.
  • We may change subscription pricing or plan features. Where pricing changes affect your plan, we will give you reasonable advance notice, and changes will apply from your next billing cycle.

4. Payments

Payments are processed securely through our third-party payment provider, Paystack. By submitting payment details you authorise us, through our payment provider, to charge the applicable fees to your chosen payment method. We do not store full card details on our systems. If a payment fails or is reversed, we may suspend or limit access to the service until payment is resolved.

6. Acceptable use

You agree not to use our services to:

  • breach any applicable law, regulation, or third-party right;
  • upload or process unlawful, harmful, or infringing content;
  • attempt to gain unauthorised access to, disrupt, or compromise our systems or other users; or
  • resell, sublicense, or misuse the service in a manner not permitted under these Terms.

We may suspend or terminate access where we reasonably believe these Terms have been breached.

7. Cancellation and refunds

You may cancel your subscription at any time as described in our Cancellation Policy. Refund eligibility and the process for requesting a refund are set out in our Refund Policy. Both policies form part of these Terms.

8. Intellectual property

All intellectual property in our website, software, models, and materials remains the property of Pro Tech AI or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable right to use the service for its intended purpose during your active subscription period.

9. Service availability and warranties

We aim to provide a reliable service but do not warrant that the service will be uninterrupted or error-free. To the maximum extent permitted by law, and without limiting your rights under the Consumer Protection Act, 2008, the service is provided "as is" and "as available".

10. Limitation of liability

To the maximum extent permitted by law, Pro Tech AI shall not be liable for any indirect, incidental, or consequential loss arising from the use of, or inability to use, the service. Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them. Nothing in these Terms limits any rights you may have under the Consumer Protection Act, 2008, or other applicable law.

12. Changes to these Terms

We may update these Terms from time to time. The latest version will always be published on this page with the updated effective date. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
